Trademark a Slogan


According to the United States Patent and Trademark Office (USPTO), trademarks protect words and symbols that distinguish products or services from those of other sellers or manufacturers and indicate the source of the product or service. In other words, a trademark must indicate that the product is sold specifically by you or your company as opposed to anyone else. To trademark a slogan, follow the USPTO's guidelines.


Instructions


1. Familiarize yourself with the basic principles and guidelines of trademark registration. The USPTO offers an online FAQ and Fact Booklet.


2. Search for existing trademarks that could conflict with the one you want to register. Use the free Trademark Electronic Search System (TESS) on the USPTO website.


3. Write a description of your product or service. This is known as an identification of goods/services. It must be specific enough to set your service or product apart from anything similar. For help with this document, there is an Acceptable Identification of Goods and Services Manual available through the USPTO.


4. Include a representation of your mark with the application. A slogan should be submitted in standard character format, meaning that you are not making claim to any specific font, color, style or design. You are submitting the words only.


5. File a trademark application with the USPTO through the Trademark Electronic Application System (TEAS), paying the fee by electronic funds transfer or credit card. Filing fees vary but will likely be between $275 and $325 to file online or $375 to file on paper.


6. You will receive a serial number as a receipt. Use this serial number for all future communication with the USPTO regarding the trademark.


7. Plan to wait 5 to 6 months to receive a response to your application. You may check the status of your application on the Trademark Applications and Registrations Retrieval database (TARR).


Tips Warnings


The application process can be completed on paper but it is more expensive and will take significantly longer than filing electronically.
