Seal Your Criminal Background In Georgia

Under certain circumstances, it is possible to seal criminal charges in Georgia.


Georgia law provides for the expungement of certain crimes by local law agencies. Although expunged records are still available to certain law enforcement and court officials even after they has been sealed, they are inaccessible to the public. Title 35 of the state code provides the specific cases for which sealing of arrest records is permissible, which includes cases in which charges have been dismissed and no other criminal charges are pending against an individual. The ultimate decision regarding the sealing of records is left up to the prosecuting attorney.


Instructions


1. Obtain a copy of the Request to Expunge Record form. This can be found online at the Georgia Bureau of Investigation's website, or you can request one from the law agency under whose jurisdiction you were arrested. Keep in mind you must fill out a separate application for each incident you wish to expunge.


2. Complete the first section of the application--this involves basic information about yourself and the circumstances surrounding your arrest.


3. Submit the form to the arresting law agency, which must complete section 2. The agency will forward the application to the prosecuting attorney, who is left with the choice of either approving or denying your application in section 3. If the application is approved, it will be returned to you.


4. Mail your application, along with a $25 (as of 2010) money order or a check payable to the Georgia Bureau of Investigation to:
